TikTok Hit with €530 Million Fine Over EU Data Protection Breaches and May Face Tougher Measures

TikTok, the popular short-video platform owned by China’s ByteDance, has been fined €530 million ($600 million) by Ireland’s Data Protection Commissioner (DPC) due to concerns about how it handles user data in Europe.

This fine follows the findings of an extensive probe into TikTok’s data protection practices, particularly regarding its operations in the European Union. TikTok now faces a strict order to suspend all transfers of European users’ personal data to China if the company does not bring its data processing into full compliance within six months.

The DPC’s investigation revealed that TikTok failed to adequately demonstrate that the personal data of European users was sufficiently protected, especially when certain data was being accessed by TikTok employees in China.

The DPC raised concerns about potential access by Chinese authorities, under Chinese laws like counter-espionage, that could undermine the high standards of data protection required by EU law. In particular, the issue revolves around whether Chinese authorities could access this data and whether such access aligns with EU privacy regulations.

While TikTok disputes the findings, the company has confirmed that it has granted remote access to user data under strict and controlled conditions using the EU’s own legal framework—standard contractual clauses. The platform insists that it has never received a request from Chinese authorities to access EU user data and has never provided any data to them.

TikTok’s Response and Appeal

TikTok has expressed strong disagreement with the ruling, stating that it plans to appeal the decision. The company also emphasized its recent improvements in data security, including independent monitoring of remote access and the storage of EU user data in dedicated data centers located in Europe and the United States. TikTok insists that it has always followed the EU’s data protection laws and that its security measures introduced in 2023 address many of the concerns raised in the DPC’s investigation.

The DPC noted that TikTok had initially denied storing EU user data on servers in China, but the company disclosed that some limited data had been stored there in February 2025. Although this data has since been deleted, the DPC has raised serious concerns about this revelation and is considering further regulatory action.

Potential Consequences for TikTok and Others

This ruling could set a significant precedent for global companies operating in the EU, potentially affecting the way user data is managed across international borders. TikTok has warned that the decision could have far-reaching consequences, not only for the company itself but for other international businesses operating within the EU.

This fine is the second time TikTok has been reprimanded by the DPC. In 2023, the company was fined €345 million for mishandling children’s data in the EU. These repeated violations of the EU’s General Data Protection Regulation (GDPR) underscore the growing scrutiny faced by tech giants in the region. As the lead EU regulator for many major tech companies, the DPC has previously issued significant fines against other companies, including Meta and Microsoft.

Despite this significant setback, TikTok continues to be a dominant force in the social media landscape, with 175 million active users across Europe alone.

The company is also facing ongoing regulatory pressure from multiple jurisdictions as the debate over user privacy and data security intensifies. It remains to be seen how the appeal process will unfold and whether TikTok will be able to restore its reputation and operations in the EU without facing additional penalties.
